1. Overview Foxhole is a platform built exclusively for the military community, connecting verified military guests with trusted short-term and long-term housing options. By using Foxhole, you agree to comply with the following Terms of Service.
2. Verification & Eligibility Foxhole only allows verified military guests to book stays on the platform. Verification is handled through our secure military verification process. Hosts are either:
90% Verified Military (automatically approved after verification)
10% Civilian Property Managers (vetted by the Foxhole team and listed on behalf of the owner)
3. Host Listing Guidelines
Hosts may only upload photos that reflect the property itself. Logos, watermarks, or brand-marketing imagery are not permitted.
Listings must reflect accurate, current information about the stay.
4. Listing Compliance
All listings must include only photos of the property and its amenities.
Images containing personal branding, promotional messaging, logos, QR codes, or symbolic imagery unrelated to the property (e.g. cannabis leaves, business slogans, apparel branding) are prohibited.
Listings must be professional, clear, and appropriate for a military audience.
Hosts should treat their listing presentation with the same attention to detail and standards expected of a military product.
Listings that do not comply may be removed or edited at Foxhole’s discretion to maintain platform standards.
5. Pricing & Fees
Short-Term Stays (1–27 days): Foxhole charges a 10% service fee on each booking. This fee is deducted from the host payout.
Long-Term Stays (28+ Days): Foxhole charges a one-time 15% finder’s fee on the first month’s rent. The host receives the remaining amount directly. All monthly payments after the first month are handled privately between the host and guest.
A one-time $0.99 verification fee is charged to guests during their first booking.
6. Legal Responsibilities & Liability Foxhole is a listing and discovery platform only. Foxhole is not a property manager or legal entity involved in lease execution or enforcement. For both short-term and long-term stays:
Foxhole is not a party to any rental agreement.
Hosts are fully responsible for all lease agreements, rent collection, security deposits, maintenance, and guest communication after the initial booking.
Foxhole disclaims all liability arising from disputes between hosts and guests. All issues related to damages, disputes, or legal claims must be resolved directly between host and guest.
7. Short-Term Stay Policy
All short-term stays are governed by the terms set by the host.
Hosts are responsible for ensuring their property complies with local laws and regulations.
Hosts are responsible for any local tax collection and remittance required by law.
Foxhole is not liable for cancellations, property conditions, damages, or unfulfilled expectations.
Guests are expected to follow all house rules provided in the listing. Violation of house rules may result in removal from the platform.
8. Tax Policy Foxhole will handle and remit taxes applicable to its service fees. However, hosts are solely responsible for understanding and fulfilling any tax obligations related to their rental income, including occupancy taxes, local/state taxes, or federal income tax.
9. Platform Use & Conduct Foxhole reserves the right to remove users (guests or hosts) who violate any policies, misrepresent themselves, or engage in unprofessional behavior.
10. Dispute Resolution & Arbitration Any disputes arising out of or relating to these Terms or your use of the Foxhole platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By agreeing to these Terms, you waive the right to a trial by jury or to participate in a class action.
11. Limitation of Liability Foxhole shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the platform.
12. Indemnification You agree to indemnify and hold harmless Foxhole and its affiliates from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the platform, or your violation of these Terms.
13. User Conduct and House Rules Users agree to adhere to all house rules set forth in each listing. Hosts must ensure that their rules comply with applicable laws and are clearly communicated in their listings.
14. Content Ownership and License By posting content on Foxhole, you grant Foxhole a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display such content in connection with the platform’s operation.
15. Termination and Suspension Foxhole reserves the right to suspend or terminate your account and access to the platform at its sole discretion, without notice, for conduct that violates these Terms or is harmful to other users or Foxhole’s business interests.
16. Compliance with Local Laws Users are solely responsible for ensuring that their use of the platform and any transactions conducted comply with all applicable local, state, and federal laws and regulations.
17. Data Privacy Foxhole collects and stores user information solely for the purpose of account verification, bookings, and platform performance. We do not sell or share your personal data with third parties without your explicit consent.
18. Third-Party Services Foxhole may link or integrate with third-party services such as calendar sync platforms or payment processors. Foxhole is not responsible for the performance, reliability, or availability of these external services.
19. Communication Consent By using Foxhole, you consent to receive emails and communications related to your account, platform updates, and occasional promotional material. You may opt out of non-essential communications at any time.
20. Account Security Users are responsible for maintaining the confidentiality of their login credentials. Foxhole is not liable for unauthorized access resulting from user negligence.
21. Changes to Terms Foxhole may update these Terms of Service at any time. Continued use of the platform indicates acceptance of these terms.
